Chelsea Manning is in jail, right across the river in Virginia — for Contempt of Court.
This is especially ironic, because the people jailing her, are the ones actually demonstrating contempt for the law. When Manning was a he, he stole documents (and video) from the Army (not something I support) and leaked them to Wikileaks, which published them — and embarrassed the Army, which was caught on video in a few atrocities.
This happens every time we fight a war, whether it’s Daniel Ellsberg and/or Edward Snowden, and/or Manning, every war it seems — we have a person willing to go to jail and/or have to flee the country — in order to expose (to the American public) some hideous thing the government did not want us to know. These people don’t expect the American people to abandon the Army, it’s the American people’s Army, these whistleblowers get that, but they make the sacrifice anyway because they hope for and/or expect reform and usually it does happen, eventually.
It is legal to publish these types of classified documents, data and/or video because the government cannot use what is referred to legally as “Prior Restraint” for anything to be published (1st Amendment) including stolen and/or classified materials — as long as the publishing platform and/or newspaper — did not actually break the law to steal them. This was, and still is, the opinion of the SCOTUS — as of the Pentagon Papers case, which pitted Elsberg and Katherine Graham of the Washington Post (back when they were a real newspaper, not the trash rag they are today) against the government.
So, what is going on? The answer is shameful.
Manning was court-martialed and sentenced and then served 7 years of that sentence — before Obama commuted her sentence — hence she should be constitutionally barred from retrial on any of those convictions — but the government in this case — is asserting that Manning lied during her court-martial testimony — and that Julian Assange did not just receive the materials he/she stole from the Army — Assange helped steal them. They want Assange real bad and are willing to try any gambit to get him.
She (now a transgender woman) denies Assange directed and/or assisted her — and denies lying under oath at her court-martial — hence her confinement for Contempt of Court. This is outrageous and an abuse of power by a government willing to suborn perjury against Assange — at any cost — either morally and/or constitutionally, because they badly want to arrest him. Assange must be the unluckiest guy in history, Donald Trump and Hillary Clinton BOTH want him prosecuted, which is unfortunate because he founded Wikileaks and that organization is one of the few truth-tellers left. the American people don’t always get this concept, but these truth teller organizations are very good for us, the things which they reveal are the very things we the American people need to know.
It’s wrong to further punish this poor broken person that broke the law — but did it for a purpose which served the American people. They should remember that, and demand her release.
