The Supreme Court performs a miracle

The Supreme Court needs a press agent. They never explain anything about how clever they are so sometimes we get lost down in the trees, whilst they gaze upon the forest. This is one of those times.

The whole country is engaged in a fierce re-ignition of the gun control debate at the exact moment the Supremes formed a unique solution right out of thin air.

Furthermore it’s a solution I believe will survive legally and morally as a success for some time.

They laid the first plank in this brilliant algorithm by taking The District of Columbia v. Heller and writing: “The Second Amendment guarantees an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home.”[1]

Citizens do INDEED have a 2nd amendment right to purchase and keep a handgun for self protection. This appeared to be a setback for the gun control crowd but the Supremes had a plan so brilliant, it takes 2 decisions to pull it off.

Next they decided NOT to take a case from Connecticut challenging an assault rifle ban — Ruling without ruling this was a reasonable restriction and constitutional.

These two “rulings”, taken together, form a new paradigm like two sides of a box with an empty spot in the middle.

They form the boundaries or edges that will be the guide on how gun control will be interrupted going forward by SCOTUS.

In other words, no entities including the U.S. government will be allowed to restrict the ownership of handguns for self protection BUT certain geographically limited governmental rules will be allowed to restrict assault rifles and high capacity magazines.

This leaves New York with the laws it wants on guns and Kansas with the laws it wants and gun owners everywhere a base level of protection and places they can hunt — and use firearms like long guns legally — but those areas won’t be everywhere.

I know the entire country missed this, but it’s a big event, this framework is like a dream come true, it satisfies every different parties major concerns and it was down with a nearly silent swipe of the pen.
